Frank Castle has always been one of my favorite Marvel Comics characters. While I know that there are different iterations of him via the live-action Television show, cartoon shows, animated movies, several live-action movies, videogames, and comics - I do of course have my own ideas as a writer & over all fan as to what I think sticks & what doesn't.
1) A military tactical assassin would not run into a building screaming bloody-murder as he systematically neutralized an amassment of human targets. He'd be calm, calculating, & intentional. While certainly there is a time & place for going full-on berserker - unless it seems fitting from a tactical stand-point - it's best to be calm like a dentist or something.
2) I like how Captain America has always been The Punisher's hero. He's truly patriotic & does have a code of conduct whether everyone is able to see it or not. Explaining things doesn't change the reality of situations & there is a niceness to someone who could care less about explaining & talking - but just wants to get things done.
3) Essentially, some of the same reasons that I like The Punisher are reasons why I like DC Comics RED HOOD. The Red Hood realizes that all of the crime isn't going to be stopped, but that it can be controlled - largely through fear. Moreover, he believes that those who are to crazy or dangerous to be on some sort of leash simply need to be taken out due to the threat that they pose to society at large. The Red Hood sees the criminally bad comic book logic in Batman letting individuals like the Joker live (i.e. even though he has died a few times. LOL!)
As for me, I have my own PUNISHER-type character coming via my upcoming HELLFIRE series. He'll make his debut in HELLFIRE ANNUAL #1. Mine has a lot of unique details to him that I don't want to disclose prior to the book's release. I don't mind saying that he's an assassin for the CIA though. *Beyond my upcoming creations, Chuck Dixon has HORSEMAN & LEVON CADE. Mike Baron has his PRIVATE AMERICAN. Then the most recent that I have heard of is Mark Millar's PSYCHIC SAM - that'll be hitting on readers/viewers through multiple mediums. Needless to say, other creators have brought other characters to life who're similar in nature. And perceivable deficiency by one party creates an opportunity for others. You've just got to pick up the ball & run with it. Right?
At the end of the day, I don't just think all of this kind of thing hinges on writing & art, but the marketing matters. Frankly (no pun intended), I'd love to discuss all of that with you more.

Off Topic, but Dark Herald, I remember how much you despised Indiana Jones 5 (the dial of disney), so you may enjoy this big Indy's fan exhaustive, 4 hr critique and take down of the film. (He even has some great points on pulps and adventures that reminded me of some of your articles.)
In fairness, that first logo looks very similar to the Guristas logo from EvE Online. The Guristas are arguably the most loved of the various EvE pirate factions. My son has a Guristas mug, and a few overly-enthusiastic souls sport Guristas tattoos!
